DODGE 6.7 Diesel CLASS-ACTION LAWSUIT FILED

 Finally, the day has arrived for all the unhappy 2007 – 2009 Dodge Ram 2500 and 3500 Cummins 6.7l Diesel owners.  A Class-action lawsuit has been filed on behalf of 16 plaintiffs’ on behalf of themselves and all others similarly situated, and anyone else that wants in on it. The attorney spearheading the class-action lawsuit against CHRYSLER GROUP LLC is: W. Craft Hughes.

Below you will find the key elements of the filing. You can get a pdf of the entire filing from me by emailing: sarahlee@mycarlady.com and putting “LAWSUIT” in the subject line. Once you get this information the attorney’s names and contact information will be on the document.

2.     This action is brought as a class action pursuant to Federal Rule of Civil Procedure 23 on behalf of a Class, described more fully below, which includes all persons or entities domiciled or residing in any of the fifty states of the United States of America or in the District of Columbia who purchased at least one new 2007 through 2009 Dodge Ram 2500 or 3500 truck equipped with the 6.7 liter Cummins turbo diesel engine.

3.    The allegations of this Complaint occurred in the Counties of Greenville and Spartanburg in the State of South Carolina in addition to other counties and states nationwide.

4.    As designed and manufactured, the exhaust system of 2007 through 2009 Dodge Ram 2500 and 3500 trucks equipped with the 6.7 liter Cummins turbo diesel engine is inherently and permanently defective because it fails to effectively rid itself of diesel particulates through its regeneration process, causing soot to accumulate in the diesel particulate filter (“DPF”), turbocharger, exhaust gas recirculation (“EGR”) valve, oxygen sensors, and other associated parts. The accumulation of soot triggers the check engine light and requires those parts to be regularly replaced, repaired, or cleaned. The exhaust system occasionally manages to clean itself to the extent necessary to turn off the check engine light; however, the check engine light turns back on after soot accumulates again as a result of the exhaust system’s inherent and permanent inability to effectively rid itself of diesel particulates through its regeneration process.

5.    Defendant or its corporate predecessors in interest issued to Plaintiffs and Class Members a written manufacturer’s warranty that expressly warranted that Defendant or its corporate predecessors in interest would repair, replace, or adjust any item defective in material, workmanship, or factory preparation on 2007 through 2009 Dodge Ram 2500 and 3500 trucks equipped with the 6.7 liter Cummins turbo diesel engine. The manufacturer’s warranty also expressly warranted that Defendant or its corporate predecessors in interest would repair or replace defective emission-related parts. The manufacturer’s warranty requires that all parts and labor needed for repairs, replacement, or adjustment of defective items be free of charge to Plaintiffs and Class Members.

6. Defendant or its corporate predecessors in interest breached those express warranties, as well as the implied warranties of merchantability and fitness for a particular purpose, because the defect in the exhaust system on all 2007 through 2009 Dodge Ram trucks equipped with the 6.7 liter Cummins turbo diesel engine cannot be successfully repaired or otherwise remedied through repairs, replacements, or adjustments of items on those trucks, and because Plaintiffs and Class Members have been deprived of the value of the bargain.

7. The inherent and permanent defect in the exhaust system of 2007 through 2009 Dodge Ram 2500 and 3500 trucks equipped with the 6.7 liter Cummins turbo diesel engine significantly diminished the fair market value of those trucks.

8. In addition, Defendant engaged in unfair competition and unfair and deceptive trade practices and acts in violation of state consumer protection statutes by intentionally concealing the common defect in the exhaust system from Plaintiffs and Class Members who purchased new 2009 Dodge Ram 2500 and 3500 trucks equipped with the 6.7 liter Cummins turbo diesel engine after June 10, 2009, or by failing to warn them about said defect.

I will test drive a new 2010 Dodge Ram 2500/3500 Cummins 6.7L diesel this week and let you know what I think.

I’m putting a shout-out to any 2010 2500 or 3500 Cummins 6.7L diesel owners with more than 10,000 miles, who would like to comment on their fuel economy or any problems/or not, that they may be having with their new 2010 Dodge Ram Cummins. I would love to be able to endorse the Cummins diesel once again!

  2. How can I join this class action law suit? I have a 2007 6.7 that just broke down. The dealer says water in the fuel. The store where I buy my fuel is standing by their sample that their fuel is clean. The dealer wants 13k to fix 6 injectors and a new fuel system.

  3. I have had the same issues with my 08. The whole exhaust system was “clogged up” and the the turbo had to be gone through at only 8,000 miles!!

    I wonder when Dodge/ Chrysler is going to address the “Death Wobble” problem on these trucks?? Not Safe!!

  4. i have 2007 2500 heavy duty having same kind of problems soot build regens and turbo cleaning and turbo replacement just thought i would have to go with lemon law until i came across this posting by mycarlady if anyone has more info on this law suit and how we find out if were stuck with lemons or not please contact me thanks

  5. I have a 2008 Dodge Ram Heavy Duty 20,000 miles.. The Checks engine light comes on 3 to 4 time between oil changes.. I wonder the the “H—” Dodge is going to do about it… How can I join the Class Action suit……

  6. I have a 2007 Dodge Ram 3500, two years old and have replaced the turbo charger three times. The check engine light has been on since i bought the truck. The next thing that goes wrong i’m just going to drop it off at the dealer…. let them pay the note

  7. Have the same problem as number two above. Supposedly I have a water in the fuel damaged system. No water in fuel now, no light came on , but it started missing. Dealer says fuel problem not covered by warranty. I say typical condensation over a period of time should be protected by their separater filter.
    Is their a class action lawsuit for this, it is a huge problem here in east texas. I cannot afford $15,000.00 out of my pocket for repair. What can be done to these crooks.

  8. I HAVE A 2008 2500, AT 5000 MILES HAD TURBO WASHED THEN REPLACED, AND AT 35000 HAD ERG REPLACED, WHILE MY MILEAGE IS UP AROUND 19 COMBINED, BUT I HAVE A LOT OF HIGHWAY AND ITS DOING GOOD RIGHT NOW, I STILL WORRY…….

  9. I have a 2008 Dodge Ram 3500 which I have had numerous problemes. Check engine light comes on between oil changes and dealer replace sensor. But the problem persists. Turbo charger had to be replaced at 20,000 miles and is starting to sound like it needs it again at 32,000 miles. Loss of power at 30,000 and transfer case and front drive shaft exploded. Not happy with this truck. I have been a Dodge owner all my life.

  10. I have a 2008 Dodge Ram 2500 4X4 which I have had numerous problems. Check engine light comes on between oil changes and dealer replaces sensor. But the problem persists. They have de-sooted, flushed turbo and erg system and replaced erg valves, charged me for cleaning fuel injection system several hundred dollars – claiming not under warranty and claiming no guaranteed fix – i think they are hoping they can stall long enough for warranty to run out – even though only 15000 miles on truck – thanks Obama for bailing these bastards out!!!!

    Wish I had my 72 Chevy big block 4X4 back – only went to dealer once in eight years

  12. I have removed both my DPF and EGR. I had my 2008 Dodge Cummins to the dealer 18 times in 20 months. Finally at about 64,000, I removed all the crap. I now have 114,000 on my truck. It has not been to the dealer once after I removed all the junk. SO, remove the EGR and DPF folks. It will solve all the problems your experiencing with your truck.

  13. I have a 2007 2500 turbo diesel with the same problem as stated above. Exost carbon bild-up that trigers the check engin light. Whith the light on makes it imposible to register in Colorado do to the Emishins test that is required for diesels. The big problem im haveing now is that a dodge dealership in GA blamed my airfilter for the build-up and placed my engin on the restriction list wich means no more warenty! I need help, how might i join the law suet?

  14. I just received a call from Dodge Dealer in Lake Jackson TX. I have the smae problem, DPF full, they are blaming me for the problem saying it is related to Contaminated Fuel, The sooner I can rid myself of this truck the better.

  15. I have a 2010 Dodge Ram with the cummins engine. At 34K miles the O2 sensor was replaced then removed and cleaned at 39K miles. It appears the engine in the manufacturers design configuration will have a constant emission problem from this point on. Oh by the way, it went out of warranty at 36K. Yahoo, very disappointing that Dodge didn’t finish the exhaust system design for reliability.

  16. I have same problem as most of the above. My check engien light is coming on four to five time a month and its driving me crazy and now my engien break is starting to wishel loud. dealer says its a sensor. I grow tired of going to the dealer to see the same results. Its a 2007 dodge 2500. Makes me want my chevy back

  18. I have a 2011 Dodge Ram 3500 bought in Oct last year. I just turned over 50K and nothing wrong? Change the oil every 5K and use it as it was intended, to haul. Never has missed a beat in the mountains, loves the open roads of Kansas and wants to run 24/7. I hope they figured it out. My last Dodge Ram 3500 (2004) had 266K at trade-in and only needed two injectors replaced. Had to replace front end, but that was not engine related.

  19. Got the 2009 Dodge Ram 3500. 74,000 now(work truck-average 30-50,000 yr). Broke down along side of road last tues. found fouled fuel injector dumping to much fuel & plugged DPF filter & blew out turbo. Warranty the work. pickup up truck friday-fuel leaking out of fuel rail. back in shop. pickup sat afternoon & engine light back on by monday morning. Now they saying I have contaminated fuel(metal shavings) and i got to pay $1500 to drop & clean fuel tank. Cant guarantee that it will be better after this work. Customer service case manager was like talking t a wall. This is our 5th!!!!! dodge and it will be our last after reading this blog and the result of how they have treated this problem. We all got contaminted fuel?????? please!!!

  20. 2010 2500 At 28000 miles I had the O2 cleaned and replaced at 31k had the other O2 replaced now at 33k They replaced the O2 module left the shop went home and as soon as I got in it the next day and hit the highway the check engine popped on. going rounds with the dealership now because the salesman assured me the 07-09 problems had been fixed…well apparently not!!!!! I will never own another Dodge. should have kept my 03 5.9l

  21. I am really sorry to read this about the 6.7 cummins engine. I just went and looked at a 2007 Dodge 3500 with a 10′ flat bed with the 6.7, manual transmission, it’s supposed to be under warranty up to 100,000 miles, has a fair price, will I be throwing my money away? Does anybody know if the engines are the same in these “work trucks”? I just am disappointed that Cummins and Chrysler corp, are not making these things right, because if I bought a Ford or Chevy truck with a diesel, I know I would be throwing my money away, what a shame.

  22. Hi bruce, there are over 150 posts. And comments about how BAD this truck is. Unless you live somewhere that doesn’t smog diesels and you are willing to do another 1000 bucks to delete the dpf, Forget it. You’ll thank me later. Buy a GMC/chevy they don’t use the same system for ultralow sulfur fuel.
    If you can do the modifications, then demand another 15% off the price. These trucks are sale-proof.

  25. funny there three posts here that exactly relate to my 07 dodge 3500 with only 92000 the dealer has told me 13k to replace the injectors along with the fact that i made them replace the egr and dpf system in its entirity only 2000 ago and funny thing it is still showing the same code my insurance co is replacing the injectors because of possible vandalism due tot he waterr in the system but at the same time there was no indicator light illuminated on the dash to let me know there was water in the system i would love to be part of your class action ive actually lost 21 days of work in williston north dakota @ 30.00 per hr averave 16 hrs a day 7 days a week due to the problems with this truck and boy could i tell you some stories about how these dealers try and make every thing your fault so they dont have to warrenty any thing would like you to contact me i have almost all of the documentation to prove the problem has been passed from dealer to dealer and that some of the dealers just out right lied about the supposed work they claimed to have done thanks wally in idaho

  26. I have a 2007 Dodge Ram Quad cab with a 6.7 Cummins engine. I bought it with 7K miles at a great price and with a factory warranty still remaining. At 10K the turbo had to be changed and at 30k the Oxy sensor went bad and almost left me stranded. Prior to that, the dealer tried to “clean” the exhaust system but that did not work so they had to change the turbo.

    I have 40k on the truck now and the 0xy sensor is still bad! I would like to join your campagne law suit. Email me with any info!!

  27. 2011 Ram 2500 runs great, no problems. Only thing I’m having to change oil at 5,000 miles not the 7,500 as stated in owner’s manual. I love my truck!

  28. My 2010 2500 cummins is a big sensor problem. Atleast once a month the check engine light comes on. Like i read somewhere “sensor this sensor that!” Now the jackass service advisor “advised” me to look into purchasing an extended service contract! FOR WHAT??? In other words is he telling me the dealer will never fix this issue and that i have to dish out more cash to get it fixed???

  31. i feel the pain i have owened 2 dodge 3500 07 08 i put the coolmist system on it and wala problem gone i go about 2000 miles betwen regen and i am getting about 17 19 mpg the problem with the h2o injection is i use about 1 gal water to 2 gal of fuel power is better but this is not for power it is for anti regen and that it does very well if you go down this road i can help with the setup of the unit it is a little trickey

  33. Bought a used 2008 2500 with 60 000 km’s on it from a dodge dealership. Within 3 months dpf and egr needed replacement. Now, one year and a bit later my egr, dpf and turbo needs to replaced. Everything is still under warranty but dodge has voided the warranty do to the S&B air intake I put on. Just dodge getting out of warranty work. Anything I can do up in Canada on this?

  36. 2011 Ram 3500 HO purchased for hotshot. Acquired truck 3rd week of September 2011. I am sitting at Tomball Dodge at present for another o2 sensor. This will be 5 sensors in 3 1/2 months plus the module and wiping the trucks brain. I am beginning to wonder if I’ve made a mistake and don’t know what to due next. Buyer beware, next generation Ram 6.7 also has issues.

  37. I have 2008 2500 Quad cab 4WD 6 speed manual. Truck has 165K miles on it and check engine light came on day I bought (used. Dealer re set it and said it was a high altitude sensor. I live at about 5300 feet in Colorado and go up and down in altitude going a town away. Getting 18.6 MPG on average. Havent read any other posts about this sensor. Was I taken by the dealer?

  38. I have the 2007 2500 with the 6.7 diesel with 35,000 miles. It hasn’t failed me yet; but, has been in the shop more times than I care to think about with all the above mentioned issues. On two occassions the exhaust fumes were so strong inside the cab that I’m sure it had to be a health hazard as well. The Dodge mechanic assured me that this was a problem with the 2007 trucks; but, these had been resolved. Apparently, not. I do change the oil myself every 5,000 miles. It is amazingly sooty and you definately don’t want to get any on you. I just completed a 2,000 mile road trip and the truck performed well and is much more comfortable than my old reliable, more economic, 1992 Dodge with the 5.9L engine. I never, and repeat never, had trouble with that truck; and my son drives it now. Now, I’m wondering if it’s too late to do the Lemon Law thing?

  39. Weel i have the same problems with my 2011 2500 6.7 cummins turbo. High oil level, check engine light,last time in shop at 5500 mile they said it was the o2 sensor. couldnt find why the oil level was staying about a quart over filled. Fuelled up today 5695 miles drove home and behold the check engine light is back on. Again

  41. i have a 2011 2500 dodge diesel i brought to dealer 5 times check engine light keeps comming on says bad sensor only had trk 5 mo and 29000 miles on it all hwy never get more than 17 mpg thinking should have bought a duramax

  42. I have a 2010 3500 with a 6.7L cummins. The truck just rolled over 23,ooo miles when the check engin light appeared. After two visit to the dealer he determined the problem to be both O2 sensors. He then explained the warranty would not cover the sensors as I have a performance enhancement device on the truck.
    After reading these posts, I believe the problem is with the design and not the aftermarket equipment. I might be looking for a truck replacement soon.

  43. Everyone of these is an endorsement into the problems we have had. 3 turbo replcements on OUr 2007 Dodge Ram. Water pump. the sensors replaced . And like a lot of u we had to be without a vehicle and/or take time off work. We finally after the 3rd turbo have a steady mileage set in the hi teens. Promised 20+ . I hope this suit helps get some answers and Dodge can stay with cummmins.

  44. I have a 2007 Dodge 2500 with the 6.7 diesel and 37,000 miles that I bought brand new. Like everyone, I have problems with the burn off. It comes on so often, I know if I drive 6 miles out of town, turn around and come back the light will go out. With diesel prices above $4 a gallon, it’s been expensive. Also, my check engine light has came on and went off 4 or 5 times in the last three weeks. I had it in the shop yesterday and was told it was the turbo sensor again ( it did the same thing 6,000 miles ago). I will be out of warranty in September and it looks like Chrysler doesn’t want to do the right thing, which is fix it.
